Where are I-601 Applications Adjudicated

  • In the United States
    • United States Citizenship and Immigration Services (USCIS)
      • For aliens currently in the United States, eligible for adjustment in the United States, but inadmissible for certain grounds, can file an I-601 with one of the USCIS service centers within the United States which will adjudicate the application.
    • Executive Office of Immigration Review (EOIR) and Immigration Judges
      • For aliens in removal proceedings who are eligible for I-601 relief, the immigration judge presiding over their case adjudicates the application for waiver of inadmissibility.
  • USCIS Offices Abroad and Their Jurisdiction
    • When an I-601 application for waiver of ground of inadmissibility is submitted at a consulate, it is forwarded to the USCIS office abroad with jurisdiction to adjudicate the application for review. Most aliens must apply at the consulate in their home country, as many consulates will not take the waiver application of third country nationals. However, some European Union countries will assist other European Union nationals, but you must first contact the consulate to which you wish to apply to ensure that you will be issued a visa from that consulate.
